Der Eigentümer der Liegenschaft schließt mit seinen Gästen Mietverträge ab. Unter dem Markennamen „Mike’s Apartments GmbH“ werden die Wohnungen in der Dachauer Str. 310 in 80993 München als Serviced Apartments zur alleinigen Nutzung des jeweiligen Gastes für die Dauer der vereinbarten Mietzeit zur Verfügung gestellt.
§ 1 MIETSACHE
Die Serviced Apartments verfügen jeweils über eine separate Küche, Duschbad und Balkon zur alleinigen Nutzung des jeweiligen Gastes. In den Kellerräumen des Hauses befindet sich ein Wasch- und Trockenraum mit einer Waschmaschine und einem Trockner zur gemeinschaftlichen Nutzung aller Gäste. PKW-Stellplätze zur gemeinschaftlichen Nutzung stehen den Mietern zur Verfügung. Die jeweilige Wohnung wird möbliert vermietet. Ein Anspruch auf ein bestimmtes Serviced Apartment im Hause der Mike’s Apartments GmbH besteht nicht. Schadensersatzansprüche des Mieters bestehen nicht.
§ 2 EINZUG IN DAS APARTMENT
Die Mieträume können zu Beginn des Mietverhältnisses am jeweiligen Tag ab 15:00 Uhr bezogen werden. Die Übersendung der Check-in-Informationen am Einzugstag. Der Mieter erhält einen Code für den Eingangsbereich sowie die jeweilige Wohnungstür des Apartments.
§ 3 NUTZUNG DER APARTMENTS
Der Vermieter überlässt dem Mieter das Serviced Apartment zum vorübergehenden Gebrauch. Die Mietsache ist nur für die Verwendung als vorübergehende Wohnunterkunft für den jeweiligen Mieter vorgesehen. Eine gewerbliche Nutzung ist gesondert schriftlich mit dem Vermieter zu vereinbaren und muss vor Einzug gemeldet werden. Der Mieter darf die vorhandenen Möbel und Einrichtungsgegenstände im Rahmen des Mietvertrages nutzen. Der Mieter ist verpflichtet, das Mobiliar pfleglich zu behandeln. Der Mieter darf die gemieteten Möbel nicht aus der Wohnung entfernen. Technische Geräte sind ausschließlich im Rahmen der Vorgaben des jeweiligen Herstellers in der Betriebsanleitung zu betreiben. Es ist dem Mieter untersagt, in den Mieträumen zu rauchen. Jegliche Tierhaltung in den Mieträumen ist ausgeschlossen.
§ 4 MIETZEIT
Beginn und Ende des Mietverhältnisses sowie die Dauer der Mietzeit werden durch Vereinbarung festgelegt. Die Dauer der Mietzeit kann verlängert werden, sofern die Buchungssituation dies zulässt. Eine Verlängerung des Mietverhältnisses kommt erst dann zustande, wenn eine Bestätigung des Vermieters vorliegt. Ein Anspruch auf Verlängerung besteht nicht. Die vereinbarte Dauer der Mietzeit kann seitens des Mieters auch verkürzt werden. Im Falle einer Verkürzung der vereinbarten Mietzeit durch den Mieter kann die Mike’s Apartments GmbH eine Entschädigung für die entgangene Miete verlangen.
§ 5 MIETE
Die Höhe der Miete wird von der Mike’s Apartments GmbH festgelegt und ist bei Buchung transparent sichtbar. Die Endreinigung ist im Mietpreis enthalten. Ebenfalls im Mietpreis enthalten sind alle üblichen Betriebs- und Heizkosten, die Kosten für öffentliche Abgaben, Müllabfuhr, Wasser, Abwasser, Gas, Strom, Internet, Treppenreinigung, Gartenpflege, Internet- und Fernsehanschlüsse. Eine gesonderte Abrechnung dieser Betriebskosten erfolgt nicht.
§ 6 KAUTION
Die Mike’s Apartments GmbH kann zu Mietbeginn eine Mietsicherheit zur Absicherung gegen Schäden und zur Sicherung aller Ansprüche des Vermieters aus dem Mietverhältnis von dem Mieter verlangen. Die Höhe ist zu vereinbaren. Nach Ende der Mietzeit wird die Kaution unverzinst an den Mieter zurückgezahlt, wenn keine Ansprüche des Vermieters dagegen stehen.
§ 7 ZAHLUNGSWEISE
Die vollständige Summe ist vor dem Einzug in das Apartment an die Mike’s Apartments GmbH im Voraus zu entrichten. Für die Rechtzeitigkeit der Zahlung kommt es nicht auf die Absendung, sondern auf den Eingang des Geldes an. Geht die Zahlung nicht rechtzeitig ein, ist ein Check-in in das Apartment nicht möglich. Falls eine Kaution vereinbart wurde, ist diese zum Mietbeginn, vor Check-in, per Überweisung an den Vermieter zu leisten.
§ 8 VERPFLICHTUNG DES MIETERS ZUR SAUBERKEIT UND ORDNUNG
Der Mieter hat das Haus, die Mieträume samt den Möbeln sowie die zur gemeinschaftlichen Benutzung bestimmten Räume, Einrichtungen und Anlagen schonend und pfleglich zu behandeln, insbesondere für gehörige Reinigung, Lüftung und Heizung der Mieträume zu sorgen. Der Mieter hat die gesetzlichen Ruhezeiten einzuhalten und sich so zu verhalten, dass die Ruhe und der allgemeine Frieden im Hause gewahrt bleibt.
§ 9 HAFTUNG DES MIETERS FÜR SCHÄDEN AN DER MIETSACHE
Der Mieter hat dem Vermieter während des Mietverhältnisses auftretende Mängel an der Mietsache unverzüglich anzuzeigen. Der Mieter haftet dem Vermieter für Schäden an der Mietsache und am Mobiliar, sofern er diese schuldhaft verursacht. Der Mieter haftet auch für den Verlust von Gegenständen innerhalb des Apartments.
§ 10 BETRETEN DER WOHNUNG DURCH DEN VERMIETER
Der Vermieter darf die Apartments an üblichen Tageszeiten und ohne gesonderte Terminabsprache betreten, sofern ein berechtigtes Interesse des Vermieters besteht. Dies gilt ebenso für das Housekeeping, um zu kontrollieren oder kleinere Instandhaltungen an der Mietsache vorzunehmen.
§ 11 AUSZUG AUS DEM APARTMENT
Die Beendigung des Mietverhältnisses muss am Abreisetag bis um 10:00 Uhr erfolgen. Die Apartments müssen geräumt und in dem beim Einzug vorgefundenen Zustand an den Vermieter zurückzugeben werden. Die Endreinigung ist Sache des Vermieters. Eine Weitergabe der jeweiligen Codes ist strengstens untersagt und wird bei Vergehen strafrechtlich verfolgt.
§ 12 RECHT UND GERICHTSSTAND
Die Parteien unterliegen dem deutschen Recht unter Ausschluss des internationalen Kollisionsrechts. Gerichtsstand ist der Ort des Mietobjektes.
MIKES APARTMENTS GMBH – GENERAL TERMS AND CONDITIONS (GTC)
The owner of the property concludes rental agreements with his guests. Under the brand name “Mike’s Apartments GmbH”, the apartments at Dachauer Str. 310 in 80993 Munich are made available as serviced apartments for the sole use of the respective guest for the duration of the agreed rental period.
§ 1 RENTAL OBJECT
The serviced apartments each have a separate kitchen, shower room and balcony for the sole use of the respective guest. In the basement of the building there is a laundry and drying room with a washing machine and dryer for the shared use of all guests. Car parking spaces for communal use are available to tenants. Each apartment is rented furnished. There is no entitlement to a specific serviced apartment at “Mike’s Apartments GmbH”. The tenant is not entitled to claim damages.
§ 2 MOVING INTO THE APARTMENT
The rented rooms can be occupied from 3:00 p.m. on the respective day at the beginning of the tenancy. The check-in information will be sent on the day of moving in. The tenant will receive a code for the entrance area and the respective apartment door.
§ 3 USE OF THE APARTMENT
The landlord shall provide the Serviced Apartment to the tenant for temporary use. The rented property is only intended for use as temporary residential accommodation for the respective tenant. Any commercial use must be agreed separately in writing with the landlord and must be notified prior to moving in. The tenant may use the existing furniture and furnishings within the scope of the rental agreement. The tenant is obliged to treat the furniture with care. The tenant may not remove the rented furniture from the apartment. Technical equipment may only be used in accordance with the manufacturer’s instructions in the operating manual. The tenant is prohibited from smoking in the rented rooms. Animals may not be kept in the rented rooms.
§ 4 RENTAL PERIOD
The beginning and end of the rental relationship and the duration of the rental period shall be determined by agreement. The rental period may be extended if the booking situation permits. An extension of the tenancy shall only come into effect once confirmation has been received from the landlord. There is no entitlement to an extension. The agreed duration of the rental period can also be shortened by the tenant. In the event of a shortening of the agreed rental period by the tenant, “Mike’s Apartments GmbH” may demand compensation for the lost rent.
§ 5 RENT
The amount of the rent is determined by “Mike’s Apartments GmbH” and is transparently visible at the time of booking. The final cleaning is included in the rent. Also included in the rent are all usual operating and heating costs, the costs for public charges, garbage collection, water, sewage, gas, electricity, internet, stair cleaning, garden maintenance, internet, and television connections. These operating costs are not invoiced separately.
§ 6 DEPOSIT
“Mike’s Apartments GmbH” may demand a security deposit from the tenant at the beginning of the tenancy to protect against damage and to secure all claims of the landlord arising from the tenancy. The amount is to be agreed. At the end of the rental period, the security deposit will be returned to the tenant without interest if there are no claims of the landlord against it.
7 § METHOD OF PAYMENT
The full amount must be paid to “Mike’s Apartments GmbH” in advance before moving into the apartment. The timeliness of the payment does not depend on the date of dispatch, but on the date of receipt of the money. If the payment is not received on time, check-in to the apartment is not possible. If a deposit has been agreed, this must be paid by bank transfer to the landlord at the start of the rental period, before check-in.
§ 8 OBLIGATION OF THE TENANT TO MAINTAIN CLEANLINESS AND ORDER
The tenant must treat the house, the rented rooms including the furniture and the rooms, facilities and installations intended for communal use with care and attention, and ensure that the rented rooms are properly cleaned, ventilated, and heated. The tenant must observe the statutory rest periods and behave in such a way that the peace and quiet of the building is maintained.
§ 9 LIABILITY OF THE TENANT FOR DAMAGE TO THE RENTED PROPERTY
The tenant must notify the landlord immediately of any defects in the rented property that occur during the tenancy. The tenant is liable to the landlord for damage to the rented property and the furniture if he is culpable for causing such damage. The tenant is also liable for the loss of items within the apartment.
§ 10 ENTRX TO THE APARTMENT BY THE LANDLORD
The landlord may enter the apartments at normal times of a day and without making a separate appointment, provided that the landlord has a legitimate interest. This also applies to housekeeping in order to check or carry out minor maintenance on the rented property.
§ 11 MOVING OUT OF THE APARTMENT
The tenancy must be terminated by 10:00 a.m. on the day of departure. The apartments must be vacated and returned to the landlord in the condition in which they were found on moving in. Final cleaning is the responsibility of the landlord. Passing on the respective codes is strictly prohibited and will be prosecuted in the event of an offense.
§ 12 LAW AND PLACE OF JURISDICTION
The parties are subject to German law to the exclusion of international conflict of law’s provisions. The place of jurisdiction is the location of the rental property.
